(Hosting-NewsWire.com, June 17, 2013 ) Delhi, India -- According to the EEOC, automaker BMW and retail chain Dollar General, an umbrella company of budget-friendly Family Dollar, discriminated against black employees and applicants simply based on the criminal background checks they performed. The commission says that while the background checks themselves aren't discriminatory, the way the checks were applied without individual consideration is racist.
In the first case, an employee who had worked at BMW for 14 years was fired after his bosses checked his background check and found a misdemeanor on his record from 20 years ago.
Dollar General is facing two counts of discrimination. The first, an applicant disclosed a drug arrest six years earlier during an interview and was still offered the job. However, the job offer was revoked once the criminal background check went through. In the second, The EEOC alleges that Dollar General rejected an applicant based upon inaccurate information contained in a background check and stood by the decision even after the record was corrected.
According to the Wall Street Journal, more than 90% of employers rely on background checks, including both criminal and credit, to screen potential employees. The EEOC however, urges employers not to rely solely on the checks and individual consideration should be made for each applicant.
EEOC Chairwoman Jacqueline A. Berrien said "Title VII of the Civil Rights Act of 1964 prohibits discrimination against job applicants and employees on account of their race." Due to racial skews apparent in drug and violent arrests, non-whites are 400 times as likely to have been arrested. This means that African Americans are far more likely to be affected by background checks than white applicants.
